No justice for ongoing Burma Army crimes in northern Shan State Briefing paper by the Kachin Women’s Association Thailand

In the State Counsellor’s speech at the International Court of Justice on December 11, 2019, she unequivocally defended Burma’s justice system, and stated: “If war crimes have been committed by members of Myanmar’s Defence Services, they will be prosecuted through our military justice system, in accordance with Myanmar’s Constitution.”

We beg to differ.

In this briefing paper, we have compiled recent cases of Burma Army torture, killing and shelling of civilian targets from March to August this year in Kutkai township, northern Shan State, where there has been no justice.

In one torture case in August, a 58-year-old deaf mute farmer was arrested in his village and interrogated by troops of Burma Army Infantry Division (ID) 88, who beat him when he could not reply. He was tied up and driven around in an armored tank for two days, before being detained in the Kutkai Infantry Battalion (IB) 45 base for six days.

In the well-publicized case of the shelling of Mawhik quarter of Kutkai town on August 31, 2019, which killed two women and three children, all witnesses testify that the shells were fired from the Burma Army’s IB 45 base, despite there being no fighting in their quarter.

Villagers have been too scared of the military to complain or press charges. In only one case has the Burma Army gone through the motions of an investigation: the murder of 51-year-old Nang Htang on the night of July 3, 2019 – where all evidence points to soldiers of IB 261 who had arrived that day in her village. However, the military has blocked police involvement and sought to protect its own personnel. 

This is ominously reminiscent of the rape-murder case of two Kachin teachers in northern Shan State on the night of January 19, 2015, where evidence pointed clearly to troops of Burma Army LIB 503 who had just arrived in their village, but where justice remains elusive until today. Medical staff were threatened by the military not to release evidence from the post mortem examination, and the army commander-in-chief himself publicly threatened to sue anyone accusing the military of involvement. Until today, there has been complete impunity for this horrific crime, where the teachers were not only raped and killed, but also brutally tortured and mutilated. 

Clearly, justice is not being served under Burma’s military justice system. At the same time, fear of the military is preventing the civilian legal system from functioning. Lawyers are afraid to take up cases against the military, and in the rare instances they do, the cases are dismissed: such as the case of 28-year-old Sumlut Roi Ja — abducted, sexually assaulted and killed by the Burma Army in October 2011 – which was dismissed by the Supreme Court for “lack of evidence.”

Continued Burma Army aggression and expansion in the ethnic areas, and their prevailing power under the 2008 constitution, are the key challenges to justice in Burma.

KWAT therefore calls urgently for the Burma Army to halt military operations throughout the country, and withdraw all troops from ethnic areas, so that civilians’ lives can be protected and inclusive political negotiations can begin – towards a new federal constitution that can grant equality and justice for all ethnic peoples of Burma.

အျပည္ျပည္ဆိုင္ရာ တရားရံုး (ICJ) တြင္ ၂၀၁၉ ခုႏွစ္ ဒီဇင္ဘာလ ၁၁ ရက္ေန႔က ႏိုင္ငံေတာ္၏ အတုိင္ပင္ခံ ပုဂၢိဳလ္၏ မိန္႔ခြန္းတြင္ ျမန္မာႏိုင္ငံ၏ တရားေရး စနစ္ကို သူက ရွင္းလင္းျပတ္သားစြာ ကာကြယ္ခဲ့ၿပီး “ျမန္မာႏိုင္ငံ ကာကြယ္ေရး တပ္ဖြဲ႔မ်ားမွ တပ္ဖြဲ႔၀င္မ်ား စစ္ရာဇ၀တ္မႈမ်ား က်ဴးလြန္ခဲ့ပါက သူတို႔ဟာ ျမန္မာႏိုင္ငံ၏ ဖြဲ႔စည္းအုပ္ခ်ဳပ္ပံု အေျခခံ ဥပေဒႏွင့္ အညီ ကၽြန္မတို႔ရဲ႔ စစ္ဘက္ဆိုင္ရာ တရားေရး စနစ္မွ တဆင့္ အေရးယူျခင္းခံရမည္” ေျပာခဲ့သည္။

ဤရွင္းလင္းခ်က္စာတမ္းတြင္ မၾကာေသးမီအခ်ိန္ျဖစ္ေသာ ယခုႏွစ္အတြင္း မတ္လႏွင့္ ၾသဂုတ္လမ်ားအတြင္း ရွမ္းျပည္နယ္ေျမာက္ပိုင္း ကြတ္ခိုင္ၿမိဳ႔နယ္အတြင္း ျဖစ္ပြားခဲ့ၿပီး တရားမွ်တမႈ ရရွိျခင္း မရွိေသးေသာ ျမန္မာ့တပ္မေတာ္၏ ႏွိပ္စက္ညွင္းပမ္းမႈ၊ သတ္ျဖတ္မႈနွင့္ အရပ္ဘက္ပစ္မွတ္မ်ားကိုု လက္နက္ႀကီးျဖင့္ တိုက္ခိုက္မႈမ်ားကို စုစည္းတင္ျပထားသည္။

ၾသဂုတ္လအတြင္းက ျဖစ္ပြားခဲ့ေသာ ႏွိပ္စက္ညွင္းပမ္းမႈ ျဖစ္ရပ္တြင္ အသက္ ၅၈ ႏွစ္အရြယ္ ဆြံ႔အ နားမၾကား လယ္သမားတစ္ဦးသည္ သူ၏ ရြာတြင္ ဖမ္းဆီးခံခဲ့ရၿပီး ျမန္မာ့တပ္မေတာ္ အမွတ္ (၈၈) ေျချမန္တပ္မ မွ တပ္ဖြဲ႔၀င္မ်ားက ေမးျမန္းစစ္ေဆးခဲ့ေသာအခါ သူ႔အေနျဖင့္ ေျဖဆိုႏိုင္ျခင္း မရွိေသာေၾကာင့္ ရိုက္ႏွက္ခံခဲ့ရသည္။ သူ႔ကို တင့္ကားထဲတြင္ ၾကိဳးျဖင့္ ခ်ည္ထားခဲ့ၿပီး ႏွစ္ရက္ၾကာေအာင္ ေလ်ာက္ပတ္ေမာင္းႏွင္ခဲ့သည္။ ထို႔ေနာက္တြင္ ကြတ္ခိုင္ရွိ ေျခလ်င္တပ္ရင္း အမွတ္ (၄၅) တြင္ ေျခာက္ရက္ၾကာေအာင္ ထိန္းသိမ္းထားခဲ့သည္။

လူသိမ်ားေသာ ၂၀၁၉ ခုႏွစ္ ၾသဂုတ္လ ၃၁ ရက္ေန႔တြင္ အမ်ဳိးသမီး ႏွစ္ဦးႏွင့္ ကေလးသံုးဦး ေသဆံုးခဲ့သည့္ ကြတ္ခိုင္ၿမိဳ႔ ေမာ္ဟစ္ ရပ္ကြက္ လက္နက္ႀကီး ပစ္ခတ္မႈတြင္ မ်က္ျမင္သက္ေသမ်ား အားလံုးက သူတို႔၏ ရပ္ကြက္တြင္ မည္သည့္ တိုက္ပြဲမွ ျဖစ္ပြားျခင္းမရွိေသာ္လည္း လက္နက္ႀကီးမ်ားကို ျမန္မာ့တပ္မေတာ္ တပ္ရင္း ၄၅ စခန္းမွ ပစ္ခတ္ခဲ့ေၾကာင္း ထြက္ဆိုခဲ့ၾကသည္။

ရြာသားမ်ားမွာ တိုင္ၾကားရန္ သို႔မဟုတ္ တရားစြဲဆိုရန္အတြက္ စစ္တပ္အား အလြန္အမင္း ေၾကာက္ရြံ႔ေနခဲ့ၾကသည္။ ျမန္မာ့တပ္မေတာ္က အေရးယူေဆာင္ရြက္ခဲ့ေသာ တစ္ခုတည္းေသာ ျဖစ္ရပ္မွာ ၂၀၁၉ ခုႏွစ္ ဇူလိုင္ ၃ ရက္ ညတြင္ ျဖစ္ပြားခဲ့သည့္ အသက္ ၅၁ ႏွစ္အရြယ္ ေဒၚနန္ထန္အား သတ္ျဖတ္ခဲ့မႈျဖစ္သည္။ ယင္းျဖစ္ရပ္တြင္ အေထာက္အထားအားလံုးက သူမ၏ ရြာကို ထိုေန႔က ေရာက္ရွိလာေသာ ေျခလ်င္တပ္ရင္း ၂၆၁ မွ စစ္သားမ်ားအား ညြန္ျပလ်က္ရွိခဲ့သည္။ သို႔ရာတြင္ စစ္တပ္က ရဲမ်ား၏ ပါ၀င္မႈကို ပိတ္ပင္ထားၿပီး သူတို႔၏ စစ္သားအား ကာကြယ္ရန္ ၾကိဳးပမ္းခဲ့သည္။

ယင္းသည္ ၂၀၁၅ ခုႏွစ္ ဇႏၷ၀ါရီလ ၁၉ ရက္ ည ရွမ္းျပည္နယ္ေျမာက္ပိုင္းတြင္ ျဖစ္ပြားခဲ့ေသာ ကခ်င္ဆရာမႏွစ္ဦးအား သတ္ျဖတ္မႈႏွင့္ အလြန္ပင္ ဆင္တူသည္။ ယင္းအျဖစ္အပ်က္တြင္ အေထာက္အထားမ်ားက သူတို႔၏ ရြာသို႔ မၾကာမီက ေရာက္ရွိလာေသာ ေျချမန္တပ္ရင္း ၅၀၃ ကို ရွင္းလင္းစြာ ညြန္ျပလ်က္ရွိေသာ္လည္း ယေန႔တိုင္ အမွန္တရားမွာ တိမ္ျမဳပ္ေနဆဲ ျဖစ္သည့္။ ေဆး၀န္ထမ္းမ်ားအား ရင္ခြဲ စစ္ေဆးမႈ အေထာက္အထားမ်ားကို ထုတ္ေဖာ္ျခင္းမျပဳရန္အတြက္ စစ္တပ္က ၿခိမ္းေျခာက္ခဲ့ၿပီး တပ္မေတာ္ ကာကြယ္ေရးဦးစီးခ်ဳပ္ကိုယ္တိုင္ စစ္တပ္၏ ပါ၀င္ပတ္သက္မႈကို ေျပာဆိုေသာမည္သူကိုမဆို တရားစြဲဆိုမည္ဟု လူသိထင္ရွား ၿခိမ္းေျခာက္ခဲ့သည္။ ယေန႔ထက္တိုင္ မုဒိန္းက်င့္ သတ္ျဖတ္မႈကိုသာမက အျပင္းအထန္ ႏွိပ္စက္ညွင္းပမ္းၿပီး ခႏၵာကိုယ္အစိတ္အပိုင္းမ်ား ျဖတ္ေတာက္ခံခဲ့ရသည့္ ဆရာမႏွစ္ဦးအေပၚ ဆိုးရြား ထိတ္လန္႔ဖြယ္ ရာဇ၀တ္မႈကို က်ဴူးလြန္သူမ်ားသည္ အေရးယူခံရျခင္းမွ လံုး၀ ဥႆံုပင္ ကင္းလြတ္လ်က္ရွိေနသည္။

ျမန္မာ စစ္တပ္၏ တရားေရး စနစ္ေအာက္တြင္ အမွန္တရားကို ေဖာ္ေဆာင္ျခင္းမရွိသည္ကို ရွင္းလင္းစြာ ျမင္ရသည္။ တခ်ိန္တည္းမွာပင္ စစ္တပ္အား ေၾကာက္ရြံ႔ေနမႈသည္ အရပ္ဘက္ တရားေရး စနစ္ကို အလုပ္မျဖစ္ေအာင္ တားဆီးလ်က္ရွိသည္။ စစ္တပ္အေပၚ စြပ္စြဲထားေသာ အမႈမ်ားကို ေရွ႔ေနမ်ားက လက္ခံရန္ ေၾကာက္ရြံ႔ၾကၿပီး ရွားရွားပါးပါး လက္ခံခဲ့သည့္အခါမ်ားတြင္ပင္ အမႈမ်ားမွာ ပယ္ဖ်က္ခံရသည္။ ဥပမာအားျဖင့္ ၂၀၁၁ ခုႏွစ္ ေအာက္တိုဘာလတြင္ ျမန္မာတပ္မေတာ္၏ ဖမ္းဆီးျခင္း၊ လိင္ဆိုင္ရာ က်ဴးလြန္ေစာ္ကားျခင္းနွင့္ သတ္ျဖတ္ျခင္းကို ခံရသည့္ အသက္ ၂၈ ႏွစ္အရြယ္ ဆြမ္လြတ္ရြယ္ဂ်ာ၏ အမႈတြင္ တရားလႊတ္ေတာ္က “အေထာက္အထားခိုင္လံုမႈမရွိ” ဟုဆိုကာ ပယ္ခ်ခဲ့သည္။  

တိုင္းရင္းသားေဒသမ်ားတြင္ ျမန္မာ့တပ္မေတာ္၏ ဆက္လက္ က်ဴးေက်ာ္တိုးခ်ဲ႔မႈမ်ားနွင့္ ၂၀၀၈ ခုႏွစ္ ဖြဲ႔စည္းအုပ္ခ်ဳပ္ပံု အေျခခံ ဥပေဒေအာက္တြင္ ရရွိထားေသာ သူတို႔၏ လုပ္ပိုင္ခြင့္အာဏာတို႔သည္ ျမန္မာႏိုင္ငံတြင္ တရားမွ်တမႈအေပၚ အဓိက စိမ္ေခၚခ်က္မ်ား ျဖစ္သည္။

သို႔ျဖစ္ရာ ကခ်င္အမ်ဳိးသမီး အစည္းအရံုး-ထိုင္းႏိုင္ငံသည္ အရပ္သားမ်ား၏ အသက္ႏွင့္ဘ၀မ်ား လံုၿခံဳမႈ ရွိေစရန္နွင့္ ျမန္မာႏိုင္ငံရွိ တိုင္းရင္းသား ျပည္သူအားလံုးအတြက္ တန္းတူညီမွ်မႈႏွင့္ တရားမွ်တမႈကို အာမခံေသာ ဖက္ဒရယ္ ဖြဲ႔စည္းပံု အေျခခံဥပေဒအသစ္ ေပၚေပါက္လာေစေရးအတြက္ အားလံုးပါ၀င္ေသာ ႏိုင္ငံေရး ေစ့စပ္ညိႈႏိႈင္းမႈမ်ား စတင္ႏိုင္ေစရန္ ႏိုင္ငံတ၀ွမ္းတြင္ စစ္ဘက္ဆိုင္ရာ စစ္ဆင္ေရးမ်ားရပ္တန္႔ၿပီး တိုင္းရင္းသားေဒသမ်ားမွ တပ္ဖြဲ႔မ်ားအားလံုး ျပန္လည္ ရုတ္သိမ္းရန္ ျမန္မာ့တပ္မေတာ္အား အေရးတႀကီး ေတာင္းဆိုလိုက္သည္။
